(3)to accept engagement by a criminal suspect in a criminal case to provide him with legal advice and represent him in filing a petition or charge or obtaining a guarantor pending trial;

The rights and obligations of the guarantor /issuer and the beneficiary arising from the undertaking are determined by the terms and conditions set forth in the undertaking, including any rules, general conditions or usages specifically referred to therein, and by the provisions of this Convention.

In discharging its obligations under the undertaking and this Convention, the guarantor /issuer shall act in good faith and exercise reasonable care having due regard to generally accepted standards of international practice of independent guarantees or stand-by letters of credit.

Where the person concerned still fails to carry out the agreement within the designated time limit, the people’s court is entitled to execute the guaranty of the person concerned or the guarantor ’s property.

This Guaranty shall be binding upon the successors and assigns of the Guarantor and shall inure to the benefit of buyers successors and assigns. The death of Guarantor shall not terminate this Guaranty.

本担保书对担保人的接任者与受让者均应具有约束力，并应符合买方接任者与受让者的利益。担保人的死亡不应使本担保书终止。

The Guarantors obligation under this Guaranty shall continue in full force and effect until Sellers Obligations are fully paid, performed and discharged and buyer gives the Guarantor written notice of that fact.
