(1). The Provisions on Marine and Maritime Administrative Punishments of the People’s Republic of China, which were adopted at the 9th executive meeting of this Ministry on June 25, 2003, are hereby promulgated and shall take effect as of September 1, 2003.

《中华人民共和国海上海事行政处罚规定》已于2003年6月25日经第9次部务会议通过，现予公布，自2003年9月2日起施行。

(2). Provisions of the People’s Republic of China on Marine and Maritime Administrative Punishment

(3). In order to regulate marine and maritime administrative punishments, to protect the legitimate rights and interests of the parties concerned

为规范海上海事行政处罚行为，保护当事人的合法权益

(4). To guarantee and supervise marine and maritime administration, to maintain the maritime traffic order, and to prevent vessels from polluting the coastal waters

保障和监督海上海事行政管理，维护海上交通秩序，防止船舶污染沿海水域

(5). The present Provisions are enacted in accordance with the Maritime Traffic Safety Law, the Marine Environment Protection Law, the Administrative Punishment Law, and other relevant laws and administrative regulations.

根据《海上交通安全法》、《海洋环境保护法》、《行政处罚法》及其他有关法律、行政法规，制定本规定。

(6). Any act that is committed within the coastal waters and the relevant land areas under the jurisdiction of the People’s Republic of China and that is against marine and maritime administration

在中华人民共和国(简称中国)管辖沿海水域及相关陆域发生的违反海上海事行政管理秩序的行为

(7). Shall be subject to maritime administrative punishment according to the relevant laws and administrative regulations of China and the present Provisions.

适用中国有关法律、行政法规和本规定实施海事行政处罚。

(8). Any act that is committed within a vessel of Chinese nationality and that is against marine and maritime administration

在中国管辖沿海水域及相关陆域外但属于中国籍的海船内发生的违反海上海事行政管理秩序的行为

(9). Shall also be subject to maritime administrative punishment according to the relevant laws and administrative regulations of China and the present Provisions.

也适用中国有关法律、行政法规和本规定实施海事行政处罚。

(10). Any act that is committed by a Chinese crew member within the coastal waters and relevant land areas under the jurisdiction of China, that is against marine and maritime administration

中国籍船员在中国管辖沿海水域及相关陆域外违反海上海事行政管理秩序

(11). And that is punishable pursuant to the relevant laws and administrative regulations of China, shall be subject to maritime administrative punishment according to the relevant laws and administrative regulations of China and the present Provisions.

并且按照中国有关法律、行政法规应当处以行政处罚的行为，也适用中国有关法律、行政法规和本规定实施海事行政处罚。

(12). The terms “coastal waters”, “vessels”, “installations”, and “operations” as mentioned in the present Provisions have the same meanings as those of the corresponding terms used in the Maritime Traffic Safety Law

本规定所称沿海水域、船舶、设施、作业，其含义与《海上交通安全法》使用的同一用语的含义相同

(13). However, except there are otherwise provisions in the relevant laws and administrative regulations of China and the present Provisions.

但有关法律、行政法规和本规定另有规定的除外。

(14). Vessel operators as mentioned in the present Provisions include vessel managers.

本规定所称船舶经营人，包括船舶管理人。

(15). Installation operators as mentioned in the present Provisions include installation managers.

本规定所称设施经营人，包括设施管理人。

(16). Parties concerned as mentioned in the present Provisions include natural persons, legal persons, and other organizations, and are interchangeable with the vessel owners and operators that have committed illegal acts against maritime administration.

本规定所称当事人，包括自然人和法人以及其他组织，可以与有海事行政违法行为的船舶所有人、经营人互相替换。

(17). “Acts against marine and maritime administration” as used in the present Provisions are referred to as “illegal acts against maritime administration” for short, including

本规定所称违反海上海事行政管理秩序的行为，简称海事行政违法行为，包括下列行为

(18). Those against the administration of vessel owners, operators, and safe vessel operations

违反船舶所有人、经营人和船舶安全营运管理秩序

(19). Those against the administration of vessel and marine installation inspection;Those against the administration of vessel registration

违反船舶、海上设施检验管理秩序;违反海上船舶登记管理秩序

(20). Those against the administration of crew members; Those against the administration of sailing, berthing, and operations

(21). Those against the administration of safety guarantee for open maritime traffic;Those against the administration of safety supervision of transport of dangerous goods by sea

(22). Those against the administration of marine salvage;Those against the administration of marine salvage

(23). Those against the supervision and administration of pollution of coastal waters caused by vessels; Those against the order of investigation and handling of maritime traffic accidents; and Other illegal acts against marine and maritime administration.

(24). The laws and administrative regulations cited in the present Provisions are as follows:The Maritime Traffic Safety Law refers to the Maritime Traffic Safety Law of the People’s Republic of China

本规定援引的法律、行政法规如下:《海上交通安全法》，是指《中华人民共和国海上交通安全法》

(25). The National Flag Law refers to the National Flag Law of the People’s Republic of China;The Law on the Administration of the Entry and Exit of Citizens refers to the Law of the People’s Republic of China on the Entry and Exit of Citizens

《国旗法》，是指《中华人民共和国国旗法》;《公民出境入境管理法》，是指《中华人民共和国公民出境入境管理法》

(26). The Regulation on Vessel Registration refers to the Regulation of the People’s Republic of China on Vessel Registration

《船舶登记条例》，是指《中华人民共和国船舶登记条例》

(27). The Regulation on the Inspection of Vessel and Marine Installations refers to the Regulations of the People’s Republic of China on the Inspection of Vessel and Marine Installations

《船舶和海上设施检验条例》，是指《中华人民共和国船舶和海上设施检验条例》

(28). The Regulation on Navigation Aids refers to the Regulation of the People’s Republic of China on Navigation Aids

《航标条例》，是指《中华人民共和国航标条例》

(29). The Provisions on the Administration of Marine Navigational Warnings and Navigational Notices refers to the Provisions of the People’s Republic of China on the Administration of Marine Navigational Warnings and Navigational Notices

(30). The Regulation on the Safety Administration of Dangerous Chemicals;The Measures for the Administration of Foreign Merchants’ Participation in the Salvage of Sunk Vessels and Objects in the Coastal Waters of China

(31). The Regulation on Prevention of Environment Pollution Caused by Dismantling of Vessels;The Marine Environment Protection Law refers to the Law of the People’s Republic of China on Marine Environment Protection

《防止拆船污染环境管理条例》;《海洋环境保护法》，是指《中华人民共和国海洋环境保护法》

(32). The Regulation on the Investigation and Handling of Maritime Traffic Accidents refers to the Regulation of the People’s Republic of China on the Investigation and Handling of Maritime Traffic Accidents; and

(33). The Administrative Punishment Law refers to the Administrative Punishment Law of the People’s Republic of China.

《行政处罚法》，是指《中华人民共和国行政处罚法》。

(34). The principles of legitimacy, openness, justice, and combination of punishment and education shall be abided by in the imposition of maritime administrative punishment.

实施海事行政处罚，应当遵循合法、公开、公正，处罚与教育相结合的原则。

(35). Maritime administrative punishment shall be imposed by maritime administrative agencies according to law.

海事行政处罚，由海事管理机构依法实施。

(36). Types and Application of Marine and Maritime Administrative Punishments

海上海事行政处罚的种类和适用

(37). The types of maritime administrative punishments are as follows: Warning;Fine; Disqualification from vessel inspection

海事行政处罚的种类如下:警告;罚款;撤销船舶检验资格

(38). Revocation of the nationality certificate or temporary nationality certificate of a vessel;Confiscation of the vessel registration certificate;Detention of the job certificate of crew membership

吊销船舶国籍证书或临时船舶国籍证书;没收船舶登记证书;扣留船员职务证书

(39). Revocation of the job certificate of crew membership;Revocation of the entry and exit certificate of any sailor;Confiscation of illegal proceeds

吊销船员职务证书;吊销海员出境入境证件;没收违法所得

(40). Confiscation of vessel; and Other maritime administrative punishments provided for by laws and administrative regulations.

没收船舶;法律、行政法规规定的其他海事行政处罚。

(41). The expression “job certificate of crew membership” as mentioned in the preceding paragraph of the present Article

(42). Includes the training certificate of crew membership, the service book of crew members, the competence certificate of the crew membership, and other competence certificates.

包括船员培训合格证、船员服务簿、船员适任证书及其他适任证件。

(43). The expression “vessel registration certificate” as mentioned in the first paragraph of the present Article includes the vessel nationality certificate

本条第一款所称的船舶登记证书，包括船舶国籍证书、

(44). The vessel ownership registration certificate, the vessel mortgage registration certificate, and the bareboat charter registration.

船舶所有权登记证书、船舶抵押权登记证书、光船租赁登记证书。

(45). When giving maritime administrative punishment, a maritime administrative agency shall order the party concerned to rectify the illegal act against maritime administration or to do so within a prescribed time limit.

海事管理机构实施海事行政处罚时，应当责令当事人改正或限期改正海事行政违法行为。

(46). A party that has committed two or more illegal acts against maritime administration shall be imposed on separate maritime administrative punishments, which shall be executed together.

(47). The parties that have committed a joint illegal act against maritime administration shall be imposed on maritime administrative punishments respectively.

(48). With respect to the same illegal act against maritime administration committed by a party, the maritime administrative punishment of fine may not be imposed twice or more.

(49). The degree of a maritime administrative punishment shall be corresponding to that of the illegal act against maritime administration and to the maritime administrative liabilities to be assumed.

(50). Where an illegal act against maritime administration is minor and has been rectified in good time, and thus resulting in no damages, no maritime administrative punishment shall be imposed.
