(1). This Ordinance may be cited as the Trade Descriptions Ordinance.

本条例定名为商品说明条例，并由总督在宪报公告指定之日期起实施。

(2). """advertisement"" includes a catalogue, a circular and a price list;"

(3). """authorized officer"" means a public officer appointed under section 14;"

(6). """false trade description"" means a trade description which is false to a material degree;"

“虚假商品说明”指在实质上乃属虚假之商品说明

(7). "a trade description which, though not false, is misleading, that is to say, likely to be taken for such an indication of any of the matters specified in the definition of ""trade description"" as would be false to a material degree;"

商品说明虽非虚假但足以误导他人，亦即是，可视作对“商品说明”定义所指之任何事项作出表示，其中在实质上乃属虚假者

(8). "anything which, though not a trade description, is likely to be taken for an indication of any of the matters specified in the definition of ""trade description"" and, as such an indication, would be false to a material degree;"

任何虽非商品说明但可视作对“商品说明”定义所指之任何事项作出表示，而此种表示在实质上乃属虚假者

(9). a false indication, or anything likely to be taken as an indication which would be false,

一项虚假表示，或任何可视作虚假表示

(10). any goods comply with a standard specified or recognized by any person or implied by the approval of any person if there is no such person or no standard so specified, recognized or implied;

声称任何货品符合指定或经任何人认可或暗示同意之标准而实则并无此人或并无经指定、认可或暗示同意之标准

(11). or a false indication, or anything likely to be taken as an indication which would be false,

或一项虚假表示，或任何可视作为虚假失实之表示

(12). any goods of any class or type being goods in respect of which duty is payable under the laws of Hong Kong, are supplied free of the duty so payable in respect of that class or type of goods;

声称任何种类货品按照香港法例属于应征税货品，可免缴该类货品应征税项而获得供应

(13). or not being goods in respect of which duty is payable under the laws of Hong Kong, are supplied free of the duty so payable;

或按照香港法例并非属于应征税货品，可获得免税供应

(14). """goods"" includes vessel and aircraft. things attached to land and growing crops; "

“货品”包括船只及飞机、附属于土地之物件及生长中之农作物

(15). """goods in transit"" means goods which-are brought into Hong Kong solely for the purpose of taking them out of Hong Kong; and remain at all times in or on the vessel, aircraft or vehicle in or on which they are brought into Hong Kong;"

“转口货品”指凡输入香港之目的仅为在香港转口输出之货品;及一直存放在其运抵香港之船只、飞机或车辆上之货品

(16). """import"" means to bring, or cause to be brought, into Hong Kong;"

“进口”指输入或促使输入香港

(17). "premises"" includes any place and any stall, vehicle, vessel or aircraft;"

“楼宇”包括任何地方及任何摊档、车辆、船只或飞机

(18). """trade description"" means an indication, direct or indirect, and by whatever means given, of any of the following matters with respect to any oods or parts of goods,"

“商品说明”指下述任何事项有关任何货品或部分货品以直接或间接或者任何方式所作之表示

(19). that is to say uantity (which includes length, width, height, area, volume, capacity, weight, and number), size or gauge; method of manufacture. production, processing or reconditioning;composition;

即数量(包括长度、阔度、高度、面积、体积、容量、重量及件数)、尺码或规格;制造、生产、加工或翻新方法;成份

(20). fitness for purpose, strength, performance, behaviour or accuracy; any physical characteristics not included in the preceding paragraphs; testing by any person and results thereof; other history, including previous ownership or use;

适合用途、强度、性能、状态或精确度;任何未有包括在上述各款文内之货品资料特征;任何人所作之试验及其结果;货品之其他来历，包括以前之所有权或用途

(21). approval by any person or conformity with a type approved by any person; place or date of manufacture ， production， processing or reconditioning; person by whom manufactured， produced， processed or reconditioned;

获任何人推许或与任何人推许之种类相符;制造、生产、加工或翻新之地点及时间;从事制造、生产、加工或翻新之人

(22). """trade mark"" means trade mark relating to goods registered in Hong Kong under the Trade Marks Ordinance (Cap. 43.);trade mark registered in the register of trade marks kept under or preserved by the Trade Marks Act 1938;"

“商标”指根据《商标条例》(第43章)在香港注册之有关货物之商标;根据2938年商标法设置或备存之注册簿注册之商标

(23). a trade mark registered, or in respect of which an application for registration has been made, in a British territory or a Convention country; and capable of registration in Hong Kong under the Trade Marks Ordinance as a trade mark relating to goods,

凡属在英国属地或协约国注册或已申请注册之商标;及可根据商标条例作为货物商标在香港注册之商标

(24). In respect of which a period of 6 months has not expired since the date of the application for the registration thereof in a British territory or a Convention country.

在英国属土或协约国申请注册而自该申请之日起计六个月之限期尚未届满之商标。

(25). For the purposes of this Ordinance, goods shall be deemed to have been manufactured in the country

为执行本条例之规定起见，应视对货品作最后处理或加工之国家为其制造国家

(26). they last underwent a treatment or process which changed permanently and substantially the shape, nature, form or utility of the basic materials used in their manufacture; or produced in the country in which they were wholly grown or mined.

最后处理或加工对用作制造货品之基本原料在形态、性质、结构及实用上有永久及实质之改变;或货品生长或开采之国家为生产国家。

(27). The Commissioner may by order specify in relation to any description of goods,

总监可下令规定关于任何商品之说明

(28). what treatment or process is to be regarded for the purposes of this Ordinance as resulting or not resulting in a permanent and substantial change in shape, nature, form or utility of the basic materials used in their manufacture;

就本条例而言，何种处理或加工方法应视作为会产生或不会产生对用作制造货品之基本原料在形态、性质、结构及实用上有永久及实质上之改变

(29). in relation to any description of goods different parts of which were manufactured or produced in different countries, or of goods assembled in a country different from that in which their parts were manufactured or produced,

关于任何商品之说明，倘货品之不同零件分别在不同国家制造或生产，或者货品装配之国家异于货品零件制造或生产之国家

(30). In which of those countries the goods are to be regarded for the purposes of this Ordinance as having been manufactured or produced.

则就本条例而言，应视作该货品在该等国家之那一国制造或生产。

(31). This subsection shall not apply to goods which are the subject of a notice published under subsection (2A).

本款不适用于根据第(2A)款公布之通知中所列之货品。

(32). The Director-General of Trade may by notice in the Gazette specify in relation to any description of goods (being goods that are subject to a scheme of import or export control specified in the notice)

贸易署署长可以在政府宪报发布通知的方式，就任何该通知中列明的受进出口管制安排的商品之商品说明

(33). the place in which the goods are to be regarded for the purposes of this Ordinance as having been manufactured or produced, and any such goods shall,for the purposes of this Ordinance, be deemed to have been manufactured or produced in such place.

指明被认为是为本条例规定之目的生产或制造该类商品之地点，以及被认为是为本条例规定之目的在上述地点生产或制造的任何商品。

(34). For the purposes of this Ordinance, a trade description or statement published in any newspaper, book or periodical or in any film or sound or television broadcast

为执行本条例之规定起见，在任何报章、书籍、期刊或在任何电影、电台或电视台发播之商品说明或陈述

(35). "Notwithstanding the definition of ""false trade description"" in section 2,"

纵使第2条已有界定“虚假商品说明”之定义

(36). For the purpose of construing descriptions relating to the fineness of gold,

为对黄金成色之说明加以阐释起见

(37). a description indicating that an article, or the metal in an article, is so many carats shall be presumed to be an indication that the article or metal is of gold,

应将标明物件或物件之合金为若干K数之说明推定为表示该物件或合金含有黄金成份

(38). a trade description which indicates the fineness (whether in parts per thousand or in carats)of gold shall be a false trade description if that indication is false to any extend or degree, except by understating the fineness.

凡标明黄金成色之商品说明(不论按在一千份中黄金所占份数若干或按K数计算)，除短报黄金成色之外，倘在任何程度上所标明资料失实，即应属虚假商品说明。

(39). That its fineness is that specified in the table in the Schedule for that number of carats

所含黄金成色为附表表格所规定份量之K数

(40). "paragraph (a)shall not apply if (as in a case where the article is a precious stone)the word ""carat"" is used as a measure of weight for precious stones, and not as a measure of fineness."

(41). A trade description which indicates that any article (other than an article of pure gold)is of gold shall be a false trade description unless the article consists solely of gold alloy and contains not less than 8 carats of gold

商品说明如标明任何非足金物件为黄金制成品，除非该物件只含黄金合金及符合下列一项规定，否则即应属虚假商品说明:金含量不少于8K....(please sign in for more)

(42). "or bears a mark clearly indicating in carats, by number or by number and the letters ""k"", ""c"" or ""ct"", the fineness of the gold content; "

(43). Or bears a mark clearly indicating in parts per thousand the fineness of the gold content

(44). A mark calculated to be taken as an indication of the fineness of gold of an article which is plated with or enclose in gold alloy or gilded

(45). Or to which gold alloy is soldered or otherwise affixed, shall be a false trade description unless it is manifest from the appearance of the article that the mark refers solely to the part of the article which consists of gold alloy.

(46). Any number of 1 or 2 digits on an article which indicates or purports to indicate, or is likely to be taken as an indication of,

(47). The fineness in carats of its gold content shall be a false trade description unless the article contains at least the same proportion of pure gold as the number bears to 24.

(48). Any number of 3 digits on an article which indicates or purports to indicate, or is likely to be taken as an indication of,

(49). The fineness in number of parts per thousand of its gold content shall be a false trade description unless the article contains gold of such a standard of fineness.

(50). "For the purposes of this section ""fineness"" means the proportion of pure gold in accordance with subsection (4)or the number of parts by weight of gold in accordance with subsection (5)as the case may require."

(51). The Governor in Council may by order require that any goods specified in the order shall be marked with or accompanied by any information (whether or not amounting to or including a trade description)or instruction relating to the goods,

(52). subject to the provisions of this Ordinance, impose requirements for securing that the goods are so marked or accompanied, and regulate or prohibit the supply of goods with respect to which the requirements are not complied with;

(53). The requirements may extend to the form and manner in which the information or instruction is to be given.

(54). Where an order under this section is in force with respect to goods of any description, any person who, in the course of any trade or business, supplies or offers to supply goods of that description in contravention of the order commits an offence.

(55). An order under this section may make different provision for different circumstances

(56). in the case of goods supplied in circumstances where the information or instruction required by the order would not be conveyed until after delivery, required the whole or part thereof to be also displayed near the goods.

(57). The Governor in Council may by order require that any description of advertisements of any goods specified in the order shall contain or refer to information (whether or not amounting to or including a trade description)relating to such goods

(58). Subject to the provisions of this Ordinance impose requirements as to the inclusion of that information or of an indication of the means by which it may be obtained.

(59). a person shall be deemed toforge a trade mark who either without the assent of the proprietor of the trade mark, makes that trade mark or a mark so nearly resembling that trade mark as to be calculated to deceive;

(60). or falsifies any genuine trade mark, whether by alteration, addition, effacement or otherwise;

(61). "falsely to apply to goods a trade mark who without the assent of the proprietor of that trade mark applies that trade mark to goods, and ""forged trade mark"" shall be construed accordingly."

(62). An order under this section may specify the form and manner in which any such information or indication is to be included in advertisements of any description and may make different provision for different circumstances.

(63). Where an advertisement of any goods to be supplied in the course of any trade or business fails to comply with any requirement imposed under this section, any person who publishes the advertisement commits an offence.

(64). A person applies a trade description or trade mark or mark to goods if he affixes or annexes it to or in any manner marks it on or incorporates it with the goods themselves; or anything in, on or with which the goods are supplied;

(71). The person supplying the goods shall be deemed to have applied that trade description or trade mark or mark to the goods.

(72). Subject to the provisions of this Ordinance, any person who in the course of any trade or business applies a false trade description to any goods; or supplies or offers to supply any goods to which a false trade description is applied;

(73). Or he has in his possession for sale or for any purpose of trade or manufacture any goods to which a false trade description is applied. commits an offence.

(74). A person exposing goods for supply or having goods in his possession for supply shall be deemed to offer to supply them.

(75). Subject to the provisions of this Ordinance any person who disposes of or has in his possession any die, block, machine, or other instrument for the purpose of making, or applying to goods a false trade description commits an offence

(76). Unless he proves that he acted without intent to defraud.

(77). The following provisions of this section shall have effect where in an advertisement a trade description is used in relation to any class of goods.

(78). The trade description shall be taken as referring to all goods of the class, whether or not in existence at the time the advertisement is published

(79). For the purpose of determining whether an offence has been committed under section 7 (1)(a)(i)

(80). where goods of the class are supplied or offered to be supplied by a person publishing or displaying the advertisement, also for the purpose of determining whether an offence has been committed under section 7 (1)(a)(ii).

(81). In determining for the purposes of this section whether any goods are of a class to which a trade description used in an advertisement relates,

(82). regard shall be had not only to the form and content of the advertisement but also to the time, place, manner and frequency of its publication

(83). All other matters making it likely or unlikely that a person to whom the goods are supplied would think of the goods as belonging to the class in relation to which the trade description is used in the advertisement.

(84). or causes to be done anything referred to in paragraph (a), (b), (c)or(d), commits an offence unless he proves that he acted without intent to defraud.

(85). Subject to the provisions of this Ordinance, any person who sells or exposes or has in his possession for sale or for any purpose of trade or manufacture, any goods to which any forged trade mark is applied,

(87). For the purposes of this section, unless he proves that he acted without infringing the right of the proprietor of the trade mark conferred by section 27 of the Trade Marks Ordinance,

(88). Subject to the provisions of this Ordinance, any person who forges any trade mark; falsely applies to any goods any trade mark or any mark so nearly resembling a trade mark as to be calculated to deceive;

(89). makes any die, block, machine or other instrument for the purpose of forging, or of being used for forging, a trade mark;disposes of or has in his possession any die, block, machine or other instrument for the purpose of forging a trade mark;

(90). In any prosecution for an offence under subsection (1)(a)or (b) the burden of proving the assent of the proprietor shall lie on the defendant.

(91). It shall not be deemed to be a trade description applied or statement made in the course of a trade or business unless it is or forms part of an advertisement.

(92). Subject to the provisions of this Ordinance, any person who, in the course of any trade or business, gives,

(94). without the authority of Her Majesty, any device or emblem signifying the Queen’s Award to Industry or anything so nearly resembling such a device or emblem as to be likely to deceive;

(95). without the authority of the Governor, any device or emblem signifying the Governor’s Award for Hong Kong Design or anything so nearly resembling such a device or emblem as to be likely to deceive,

(96). by whatever means, any false indication, direct or indirect, that any goods supplied by him are or are of a kind supplied to or approved by Her Majesty or any member of the Royal Family commits an offence.

(97). Subject to the provisions of this Ordinance,any person who,in the course of any trade or business,gives,by whatever means, any false indication, direct or indirect,that any goods supplied by him are of a kind supplied to any person,commits an offence.

(98). Subject to section 13, no person shall import or export any goods to which a false trade description or forged trade mark, which expression shall be construed in accordance with section 9 (3), is applied.

(99). Any person who imports or exports any goods contrary to subsection (1)commits an offence unless he proves that--

(100). he did not know, had no reason to suspect and could not with reasonable diligence have found out that the goods are goods to which a false trade description or forged trade mark is applied; or the goods are not intended for trade or business.
