(4)Leaving post without permission or committing dereliction that causes damage to military installations or other consequences.

第八十四条 土地行政主管部门的工作人员玩忽职守、滥用职权、徇私舞弊，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，依法给予行政处分。

Article 62. State functionaries who take bribes or engage in malpractices for selfish purposes while conducting military service work or who cause serious losses to such work by their dereliction of duty shall be punished, as the circumstances may require, according to the provisions of Articles 185 and 187 of the Criminal Law of the PRC . Administrative sanctions may be given where the circumstances are less serious.

第六十二条　国家工作人员办理兵役工作时，收受贿赂、营私舞弊的，或者玩忽职守，致使兵役工作遭受严重损失的，分别依照《中华人民共和国刑法》第一百八十五条、第一百八十七条的规定处罚。情节较轻的，可以给予行政处分。

Article 39. Any person engaged in the medical care and health work, epidemic prevention, surveillance and control related to infectious diseases or any relevant responsible person of the government who causes the spread or epidemic of an infectious disease due to his dereliction of duty shall be given an administrative sanction; if the circumstances are serious enough to constitute a crime, he shall be prosecuted in accordance with Article 187 of the Criminal Law.

第三十九条 　从事传染病的医疗保健、卫生防疫、监督管理的人员和政府有关主管人员玩忽职守，造成传染病传播或者流行的，给予行政处分;情节严重、构成犯罪的，依照刑法第一百八十七条的规定追究刑事责任。

Article 34 Where any staff member concerned of the intellectual property administrative authority under the State Council commits dereliction of duty, abuses his authority and acts wrongfully out of personal considerations or commits fraudulent acts, he shall be subject to disciplinary sanction. If the act constitutes a crime, he shall be prosecuted for his criminal liability.

第三十四条 国务院知识产权行政部门的工作人员在布图设计管理工作中玩忽职守、滥用职权、徇私舞弊，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，依法给予行政处分。

Article 34 In case of incompetence, graft or serious dereliction of duty on the part of the general manager or other high-ranking management personnel, the board of directors or joint management committee may resolute to dismiss them. If any loss is incurred to the venture, the person concerned shall be liable to the loss according to law.

Article 49 The working staff of the MPUA, the MFGMO, or the county / district fuel gas administrative department that commit dereliction , abuse power and malpractice shall be given disciplinary sanction by their work unit or the superior competent department. If the irregularities constitute a crime, the wrong-doer shall be prosecuted for his/her criminal liability according to law.

第四十九条市公用局、市燃气管理处或者县(区)燃气行政管理部门的工作人员玩忽职守、滥用职权、徇私舞弊的，由其所在单位或者上级主管部门给予行政处分;构成犯罪的，依法追究刑事责任。

Article 46 Working personnel of advertising supervision and management organizations and advertisement administrative organs shall be given administrative punishments for committing dereliction of duty, abuse of their power to personal gains. If the case is serious enough to constitute a crime, criminal responsibility shall be affixed.

第四十六条 广告监督管理机关和广告审查机关的工作人员玩忽职守、滥用职权、徇私舞弊的，给予行政处分。构成犯罪的，依法追究刑事责任。

Article 46 Whereas government personnel in charge of prices have leaked State secrets, commercial secrets or abused their power, resort to deception for personal gains, commit dereliction of duty or accept bribes and the cases are serious enough as to constitute crimes, criminal responsibilities shall be affixed. If a case is not serious enough to constitute a crime, an administrative punishment shall be meted out.

第四十六条 价格工作人员泄露国家秘密、商业秘密以及滥用职权、徇私舞弊、玩忽职守、索贿受贿，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，依法给予处分。

Article 46. Where the supervisory personnel are found to have abused powers or bend the law for personal gains or to be guilty of dereliction or leaking classified information, they should be punished with administrative sanctions; criminal liability shall be affixed through the process of law if there is breach of the criminal code.

第四十六条 监察人员滥用职权、徇私舞弊、玩忽职守、泄露秘密的，依法给予行政处分;构成犯罪的，依法追究刑事责任。

Article 54 Whoever, in his work of the administration of reserve officers, takes bribes, engages in malpractices for selfish ends or causes serious losses to work of reserve service because of his dereliction of duty shall be investigated for criminal responsibility according to law if the case constitutes a crime, or shall be given administrative sanctions if the case does not constitute a crime.

第五十四条 在预备役军官管理工作中，收受贿赂、营私舞弊，或者玩忽职守致使预备役工作遭受严重损失，构成犯罪的，依法追究刑事责任;未构成犯罪的，依法给予行政处分。

Those found guilty of dereliction , power abuse, malpractice, bribe-extorting and/or taking, and distortion of the law must be sanctioned administratively by the unit they work for or its competent superior department. If the irregularities constitute a crime, the offender shall be investigated for their criminal liability accordingly.
