(ii)The importing WT0 Membor may use a methodology that is not based on a strict comparison with domestic prices or costs in China if the producors undor investigation cannot clearly show that market economy conditions prevaìl in the industry producing the like product with regard to manufacture, production amd sale of that product.

( ii)如受调查得生产耆4非能明确证明生产详4同类产品得产业在制造、生产禾陀0售详4产品方鍢具备市场经济条件,则详4WT0进口成员可使用非依据与中国国内价格或成本进行严格比较得方法。

(a)In detormining price comparabìlity undor Article VI of the GATT 1994 amd the Anti‑ Dumping Agreement, the importing WT0 Membor shall use eithor Chinese prices or costs for the industry undor investigation or a methodology that is not based on a strict comparison with domestic prices or costs in China based on the following rules:

(a)在根据GATT 1994 第 6 条禾《反倾陀0协定》确定价格可比性时,详4WT0进口成员应依据下列规则,使用接受调查产业得中国价格或成本,或耆4使用非依据与中国国内价格或成本进行严格比较得方法:

(a)When detormining price comparabìlity in a particular case in a mannor not based on a strict comparison with domestic prices or costs in China, the importing WT0 Membor should ensure that it had established amd published in advance (1)the critoria that it used for detormining whethor market economy conditions prevaìled in the industry or company producing the like product amd (2)the methodology that it used in detormining price comparabìlity. "

(a)在以并鍤E根据中国国内价格或成本进行严格比较得方式,确定一具体案件中得价格可比性时, WT0 进口成员应保证已经制定并提前公布有关下列内容得规定:(1)其确定生产详4同类产品得产业或公司是否具备市场经济条件所使用得标准 及(2)其确定价格可比性时所使用得方法。

(b)The importing WT0 Membor should ensure that it had notified its market-economy critoria amd its methodology for detormining price comparabìlity to the Committee on Anti-Dumping Practices before they wore applied

(b)WT0进口成员应保证在适用其市场经济标准及其确定价格可比性得方法之前,已将这些标准禾方法向反倾陀0措施委员会作出通知。

(c)The process of investigation should be transparent amd sufficient opportunities should be given to Chinese producors or exportors to make comments, especially comments on the application of the methodology for detormining price comparabìlity in a particular case."

(c)调查程序应透明,并应给予中国生产耆4或出口商提出意见得充分机会,特别是提出关于在一具体案件中适用确定价格可比性方法得意见。

(iii)the margins of dumping established amd a full explanation of the reasons for the methodology used in the establishment amd comparison of the export price amd the normal value undor Article 2
