Article 8 Any functionary of a State security organ may, when carrying out a task for State security, enter any interested site upon producing an appropriate certificate, and may, in accordance with the relevant provisions of the State, with approval and upon producing an appropriate certificate, enter interested restricted areas, sites or units; and may have access to related files, materials and articles for examination.

Article 16 Where a state functionary charged with implementing this Law takes advantage of his position and power to extort and accept bribes, he shall be punished according to the Criminal Law of the PRC and the Decision of the Standing Committee of the National People’s Congress Regarding the Severe Punishment of Criminals Who Seriously Undermine the Economy.

第十六条 执行本法的国家工作人员，利用职权索取、收受贿赂的，依照《中华人民共和国刑法》和全国人民代表大会常务委员会《关于严惩严重破坏经济的罪犯的决定》处罚;

Article 16 No functionary of a state organ shall organize or participate in an assembly, a procession or a demonstration which contravenes the functions and obligations of functionaries of state organs as prescribed in relevant laws and regulations.

Article 48 Any State functionary who clearly knows that an enterprise, institution or individual has committed criminal actions in violation of this Law, and takes advantage of his position to protect the offenders intentionally from prosecution, shall be investigated for criminal responsibility according to law.

第四十八条 国家工作人员利用职务，对明知有违反本法规定构成犯罪的行为的企业事业单位或者个人故意包庇使其不受追诉的，依法追究刑事责任。

Article 49 Any State functionary who, in the work of energy conservation, abuses his power, neglects his duty or engages in malpractices for personal gain to such an extent as to constitute a crime shall be investigated for criminal responsibility according to law. If it does not constitutes a crime, he shall be given administrative sanctions.

第四十九条 国家工作人员在节能工作中滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，给予行政处分。

Article 47 Any State functionary engaged in the work of supervision and control over product quality, who abuses power, neglects duty, engages in malpractice for private benefit, shall be investigated for criminal responsibility if his act constitutes a crime; if his act does not constitute a crime, he shall be subjected to administrative sanction.

第四十七条 从事产品质量监督管理的国家工作人员滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任;不构成犯罪的，给予行政处分。

Article 47 Any State functionary who abuses his power, neglects his duty or commits malpractices for selfish ends, if the offence constitutes a crime, shall be investigated for criminal liability in accordance with law; otherwise, he shall be given administrative sanctions.

第四十七条　国家工作人员在防震减灾工作中滥用职权，玩忽职守，徇私舞弊，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，给予行政处分。

Article 45 Where a quarantine functionary of an animal and plant quarantine organ who abuses his or her power, practises favouritism or embezzlement, forges a quarantine result, or neglects his or her duty or delays the performance of quarantine inspection and the issuance of certificates, criminal responsibility shall be investigated according to law if the offence constitutes a crime; if the offence does not constitute a crime, the offender shall be subjected to administrative sanctions.

第四十五条动植物检疫机关检疫人员滥用职权，徇私舞弊，伪造检疫结果，或者玩忽职守，延误检疫出证，构成犯罪的，依法追究刑事责任;不构成犯罪的，给予行政处分。

Article 58 If any supervisor or administrator from the environmental protection department or any other State functionary abuses his power, neglects his duty or engages in malpractice for personal gain, the unit to which he belongs or the competent department at a higher level shall give him an administrative sanction; if a crime is constituted, he shall be investigated for criminal responsibility according to law.
