(1)Name or designation and address of the mortgagee and the name or designation and address of the mortgagor of the ship;

Abut where there are 2 or more mortgages of the same ship, a subsequent mortgagee shall not, except under the order of a court, dispose of the ship without the consent of every prior mortgagee.

但如同一船舶有2宗或超过2宗抵押,则较后的抵押权人如未得各位较先的抵押权人的同意,不得将该船舶脱手,但根据法院命令而脱手的,则属例外。

If the mortgagee fails to notify the person who has the obligation to pay legal fruits of the fact that the mortgaged property is seized, the mortgagee's right shall not extend to such fruits.

抵押权人未将扣押抵押物的事实通知应当清偿法定孳息的义务人的,抵押权的效力不及于该孳息。

The proceeds which the mortgagor obtains from the transfer of the mortgaged property shall first be used to liquidate the claim secured by the mortgage or it shall be deposited with a third party agreed upon by the mortgagor and the mortgagee .

抵押人转让抵押物所得的价款,应当向抵押权人提前清偿所担保的债权或者向与抵押权人约定的第三人提存。

Where the value of the mortgaged property has declined, the mortgagee shall be entitled to demand that the mortgagor restore the original value of the mortgaged property or provide security corresponding to the amount of the lost value.

抵押物价值减少时,抵押权人有权要求抵押人恢复抵押物的价值,或者提供与减少的价值相当的担保。

Article 20 The mortgages shall be extinguished when the mortgaged ship is lost. With respect to the compensation paid from the insurance coverage on account of the loss of the ship, the mortgagee shall be entitled to enjoy priority in compensation over other creditors.

第二十条 被低押船舶灭失,抵押权随之消灭。由于船舶灭失得到的保险赔偿,抵押权人有权优先于其他债权人受偿。

Article 38 A mortgagor and a mortgagee shall conclude a mortgage contract in writing.

第三十八条抵押人和抵押权人应当以书面形式订立抵押合同。

Article 36. If the mortgagor fails to fulfil liabilities within the prescribed period of time or declares dissolution or bankruptcy within the term of the mortgage contract, the mortgagee shall have the right to dispose of the mortgaged property in accordance with the laws and regulations of the State and the stipulations of the mortgage contract.

第三十六条　抵押人到期未能履行债务或者在抵押合同期间宣告解散、破产的,抵押权人有权依照国家法律、法规和抵押合同的规定处分抵押财产。

Article 37. The mortgagee shall have the priority of compensation with respect to the receipts resulting from the disposal of the mortgaged property.

第三十七条　处分抵押财产所得,抵押权人有优先受偿权。

Article 33 A maritime court, 30 days prior to auction of the ship, shall issue notices to the registration authorities of the country of registry of the ship to be auctioned, and to the known lienor, mortgagee and owner of the ship.

第三十三条海事法院应当在拍卖船舶三十日前,向被拍卖船舶登记国的登记机关和已知的船舶优先权人、抵押权人和船舶所有人发出通知。

Article 34. A mortgage contract shall be signed for mortgaging the right to the use of the land by and between the mortgagor and the mortgagee .

第三十四条　土地使用权抵押,抵押人与抵押权人应当签订抵押合同。

Article 18 In case the mortgagee has transferred all or part of his right to debt secured by the mortgaged ship to another person, the mortgage shall be transferred accordingly.

第十八条 抵押权人将被抵押舶舶所担保的债权全部或者部分转让他人的,抵押权随之转移。

Article 16 The mortgage of a civil aircraft shall be established by registering the mortgage of the civil aircraft with the competent civil aviation authority under the State Council jointly by the mortgagee and the mortgagor; no mortgage may act against a third party unless registered.

第十六条 设定民用航空器抵押权,由抵押权人和抵押人共同向国务院民用航空主管部门办理抵押权登记;未经登记的,不得对抗第三人。

Article 17 Once a mortgage is established on a ship, the ownership of the mortgaged ship shall not be transferred without the consent of the mortgagee .

第十七条 船舶抵押权设定后,未经抵押权人同意,抵押人不得将被抵押船舶转让给他人。

Article 17 Once a mortgage is established on a civil aircraft, the ownership of the mortgaged civil aircraft shall not be transferred without the consent of the mortgagee .

第十七条 民用航空器抵押权设定后,未经抵押权人同意,抵押人不得将被抵押民用航空器转让他人。

Article 13 The mortgage of a ship shall be established by registering the mortgage of the ship with the ship registration authorities jointly by the mortgagee and the mortgagor. No mortgage may act against a third party unless registered.

第十三条 设定船舶抵押权,由抵押权人和抵押人共同向船舶登记机关办理抵押权登记;未经登记的,不得对抗第三人。

Article 15 The mortgaged ship shall be insured by the mortgagor unless the contract provides otherwise. In case the ship is not insured, the mortgagee has the right to place the ship under insurance coverage and the mortgagor shall pay for the premium thereof.

第十五条 除合同另有约定外,抵押人应当对被抵押船舶进行保险;未保险的,抵押权人有权对该船舶进行保险,保险费由抵押人负担。

Article 11 The right of mortgage with respect to a ship is the right of preferred compensation enjoyed by the mortgagee of that ship from the proceeds of the auction sale made in accordance with law where and when the mortgagor fails to pay his debt to the mortgagee secured by the mortgage of that ship.

第十一条 船舶抵押权,是指抵押权人对于抵押人提供的作为债务担保的船舶,在抵押人不履行债务时,可以依法拍卖,从卖得的价款中优先受偿的权利

Article 49 If a mortgagor transfers mortgaged property already registered during the period of mortgage, he shall notify the mortgagee and inform the transferee that the transferred property is mortgaged; if the mortgagor fails to notify the mortgagee or inform the transferee of the fact, the transfer shall be null and void.

第四十九条抵押期间,抵押人转让已办理登记的抵押物的,应当通知抵押权人并告知受让人转让物已经抵押的情况;抵押人未通知抵押权人或者未告知受让人的,转让行为无效。

Article 47 If the mortgaged property is seized by a People's Court because of the debtor's failure to perform his obligation prior to the maturity of the debt, the mortgagee shall, from the date of seizure, be entitled to collect the natural fruits severed from the mortgaged property and the legal fruits which the mortgagor may collect from the mortgaged property.

第四十七条债务履行期届满,债务人不履行债务致使抵押物被人民法院依法扣押的,自扣押之日起抵押权人有权收取由抵押物分离的天然孳息以及抵押人就抵押物可以收取的法定孳息。

Article 40 In concluding a mortgage contract, the mortgagor and the mortgagee may not stipulate that the ownership of the mortgaged property shall be transferred to the creditor in case the mortgagee's claim is not satisfied after maturity of the debt.

第四十条订立抵押合同时,抵押权人和抵押人在合同中不得约定在债务履行期届满抵押权人未受清偿时,抵押物的所有权转移为债权人所有。

Article 59 A mortgage of maximum amount as used in this Law means that the mortgaged property shall be used to secure the creditor's claims which occur successively during a given period of time and to the extent of the total amount of the claims, as agreed upon between a mortgagor and a mortgagee .

第五十九条本法所称最高额抵押,是指抵押人与抵押权人协议,在最高债权额限度内,以抵押物对一定期间内连续发生的债权作担保。
