(8)cases where an administrative body is held to have infringed upon other personal rights and property rights;

(八)认为行政机关侵犯其他人身权、财产权的;

(3)cases for which the victims have evidence to prove that the defendants should be investigated for criminal responsibility according to law because their acts have infringed upon the victims’ personal or property rights, whereas, the public security organs or the People’s Procuratorates do not investigate the criminal responsibility of the accused.

(三)被害人有证据证明对被告人侵犯自己人身、财产权利的行为应当依法追究刑事责任，而公安机关或者人民检察院不予追究被告人刑事责任的案件。

Article 27 Where the registered name of one enterprise is used without authorization by another enterprise or the former’s exclusive right to use of its registered name is infringed in any other way, the infringed party may apply to the registration authority of the area where the infringer is located for handling the case.

第二十七条 擅自使用他人已经登记注册的企业名称或者有其他侵犯他人企业名称专用权行为的，被侵权人可以向侵权人所在地登记主管机关要求处理。

Article 2. Where citizens, legal persons or other organizations hold that a specific administrative act of an administrative body has infringed upon their lawful rights and interests, they may, in accordance with these Regulations, file an application to the competent administrative body for reconsideration.

第二条 公民、法人或者其他组织认为行政机关的具体行政行为侵犯其合法权益，可以依照本条例向行政机关申请复议。

第三十九条教师对学校或者其他教育机构侵犯其合法权益的，或者对学校或者其他教育机构作出的处理不服的，可以向教育行政部门提出申诉，教育行政部门应当在接到申诉的三十日内，作出处理。

Article 30. Women shall enjoy equal rights with men in the allotment of responsibility farmland, or grain ration farmland and in the approval of housing sites in rural areas, and women’s lawful rights thereto shall not be infringed upon.

第三十条农村划分责任田、口粮田等，以及批准宅基地，妇女与男子享有平等权利，不得侵害妇女的合法权益。

Article 18. When a person’s right of ownership of grasslands or his right to use them has been infringed upon, he may apply for settlement to the farming and animal husbandry department of the local people’s government at the county level or above. The farming and animal husbandry department concerned shall have the power to order the infringing party to stop such infringement and compensate for the losses sustained by the victim. The victim may also directly file a suit in a people’s court.

第十八条　草原所有权、使用权受到侵犯的，被侵权人可以请求县级以上地方人民政府农牧业部门处理。有关农牧业部门有权责令侵权人停止侵权行为，赔偿损失。被侵权人也可以直接向人民法院起诉。

Article 14. The property which the state has authorized the enterprise to operate and manage shall be protected by law and shall not be infringed upon.

第十四条 国家授予企业经营管理的财产受法律保护，不受侵犯。

Article 15. The lawful rights and interests of the enterprise shall be protected by law and shall not be infringed upon.

第十五条 企业的合法权益受法律保护，不受侵犯。

Article 48. When a woman’s lawful rights and interests are infringed upon, she has the right to request the competent department concerned for a disposition or bring a lawsuit in a people’s court according to law.

第四十八条妇女的合法权益受到侵害时，被侵害人有权要求有关主管部门处理，或者依法向人民法院提起诉讼。

Article 42. The public security organs shall admit their mistakes to those who are punished by mistake and return fines and the confiscated property; in case the legal rights and interests of those who are so punished have been infringed upon, the loss shall be compensated for.

第四十二条 公安机关对公民给予的治安管理处罚错误的，应当向受处罚人承认错误，退回罚款及没收的财物;对受处罚人的合法权益造成损害的，应当赔偿损失。
