(i)The National People’s Congress has the authority to amend or cancel any inappropriate national law enacted by its Standing Committee, and to cancel any autonomous decree or special decree approved by its Standing Committee in violation of the Constitution or the provision of Paragraph 2 of Article 66 hereof ;

( 一)全国人民代表大会有权改变或者撤销它的常务委员会制定的不适当的法律，有权撤销全国人民代表大会常务委员会批准的违背宪法和本法第六十六条第二款规定的自治条例和单行条例;

(subject to extensions of the Schedules in the same format, and to the provisions of Clause 14.2 hereof regarding the alternative forms of tender security).

(除了按同样格式延长目录表和按条款十四(二)的规定使用可供选择的投标保证书格式)

22.2 Tenders for which an acceptable notice of withdrawal has been submitted pursuant to Clause 21 hereof shall not be opened.

(二)按条款二十一提交了撤标通知的标书将不再打开。

21.3 Subject to Clause 24 hereof , no tender may be modified subsequent to the deadline for submission of tenders.

(三)按条款二十四的规定，任何标书在最后期限后不能再进行修改。

8.3 In order to afford prospective tenderers reasonable time in which to take an Addendum into account in preparing their tenders, the Employer or his agent _________ may, at their discretion, extend the deadline for the submission of tenders in accordance with Clause 19 hereof .

(三)为了使投标者在准备投标时有时间考虑附录文件，业主或其代理人A公司可按条款十九的规定延长投标期限。

32.3 Upon the furnishing by the successful tenderer of a performance security in accordance with the provisions of Clause 34 hereof , the Employer will promptly notify the other tenderers that their tenders have been unsuccessful.

(三)在成功投标者按条款三十四提交一份履约保函后，业主立即通知其他投标者他们的投标不成功。

17.4 Only one tender may be submitted by each tenderer, not including alternative offers submitted pursuant to Clause 15 hereof .

(四)每位投标者只能提交一份标书，不包括按条款十五提交的供选择方案。

34.4 Failure of the successful tenderer to comply with the requirements of Clauses 33 or 34 hereof shall constitute sufficient grounds for the annulment of the award and forfeiture of the tender security,

(四)如果成功投标者未遵守条款三十三、三十四的要求，将构成充足理由使业主取消对其授标，投标者还将失去投标保证书。

12.4 Tenderers may be required by the Employer to clarify their foreign currency requirements, and to provide satisfactory proof that the amounts included in the unit rates and in Schedule I are reasonable and responsive to sub-clause 12.1 hereof .

(四)业主可以要求投标者说明其外币需求的情况，提供证明，证明其单位价格和表一中所需部分是合理的。

(1)The total investable amount of an insurance company shall not exceed 80% of the balance of its foreign exchange funds at the end of the previous year. In any of the circumstances specified in Article 8 hereof , the total investable amount shall not exceed 80% of the aggregate of the balance of foreign exchange funds at the end of the previous year and increased funds;

(一)保险公司的可投资总额，不得超过公司上年末外汇资金余额的 80 %，保险公司出现本办法第八条规定情形的，其可投资总额不得超过其上年末外汇资金余额与增加资金合计的 80 %;

11.1 Unless explicitly stated otherwise in the tender documents, the Contract shall be for the whole of the Works ______ as described in Clause 1 hereof , based on the schedules of unit rates and amounts submitted by the tenderer.

(一)除非合同中另有明确规定，合同包括条款一所述全部工程，以投标者提供的项目单价和总价为基础。

17.1 The tenderer shall prepare one original and two duplicate copies of the documents comprising the tender as described in Clause 10.1 hereof , bound within the Volume 3, and clearly marked “Original Tender” and “Duplicate Tender” as appropriate.

(一)投标者应准备条款十(一)规定的标书的一个原本和两个副本，并分别注明 “ 原本 ” 和 “ 副本 ” 。

28.1 The Employer and _____________ Company will evaluate and compare only those tenders determined to be substantially responsive to the requirements of the tender documents in accordance with Clause 25 hereof .

(一)业主和A公司只评价和比较那些被判定符合投标文件要求的标书。

(1) Organization of a bid committee by the developer in accordance with the requirements of Article 10 hereof ;

Provisions contained in this ticket; (2)applicable tariffs; (3)carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier).

Where there is no express provision in the Specific Provisions hereof or any other law concerning a certain contract

Appendices hereof shall be integral parts of Contract and have the same legal force as the text of Contract itself.

本合同的附件为本合同不可分割的组成部分,与合同正文具有同等法律效力。

Upon the execution of this contract, unless otherwise required by laws and regulations, no public disclosure of the subject matter hereof shall be made by either party unless approved in writing by the other party prior to its release

本合同签署后,任何一方事先未征得对方书面同意,不得公开披露本合同标的,但法律和法规要求公开的除外。

The terms and conditions incorporated herein contain the entire agreement and understanding between the parties with respect to the subject matter hereof and merge and supersede all prior agreements,understandings and representations.

Where a contract is concluded by the exchange of electronic messages, the time of arrival of the acceptance shall be governed by Paragraph 2 of Article 16 hereof .

采用数据电文形式订立合同的，承诺到达的时间适用本法第十六条第二款的规定。
