(5). With a view to strengthening and regulating the inspection, supervision and administration over import of used mechanical and electric products, and ensuring the safe quality of such products imported, these Provisions

为进一步加强和规范进口旧机电产品的检验监督管理工作，保证进口旧机电产品的安全质量

(6). Are formulated in accordance with the Law of the People’s Republic of China on Import and Export Commodity Inspection (hereinafter referred to as the Commodity Inspection Law)and the implementation rules thereof.

根据《中华人民共和国进出口商品检验法》(以下简称商检法)及其实施条例的规定，制定本规定。

(7). The State Administration of Quality Supervision, Inspection and Quarantine (SIQSAQ)is in charge of the inspection, supervision and administration over import of used mechanical and electric products.

国家质量监督检验检疫总局(以下简称国家质检总局)主管全国进口旧机电产品的检验监督管理工作。

(8). Local administrations of entry-exit inspection and quarantine directly under SIQSAQ are in charge of the inspection, supervision and administration over import of used mechanical and electric products within their localities.

国家质检总局设在各地的出入境检验检疫机构(以下简称检验检疫机构)负责所辖地区进口旧机电产品的检验监督管理工作。

(9). The inspection, supervision and administration over import of used mechanical and electric products include such items as follows: record-keeping, pre-inspection before shipment, arrival inspection, supervision and administration, etc.

进口旧机电产品的检验监督管理包括:进口旧机电产品备案、装运前预检验、到货检验和监督管理等。

(10). The inspection, supervision and administration over import of used mechanical and electric products imported shall conform to the laws, regulations and administrative rules on mechanical and electric safety

对进口旧机电产品的检验监督管理应当符合国家有关机械安全、电气安全、

(11). Environmental protection, food hygiene, labor protection, etc. as well as the compulsory requirements of other technical norms of the state.

(12). The term “record-keeping for import of used mechanical and electric products”

“进口旧机电产品备案”

(13). Refers to the application for goods registration and record-keeping made prior to the signing of contract by a consignee or its agent of used mechanical and electric products whose import is permitted by the state

是指国家允许进口的旧机电产品的收货人或者其代理人在合同签署之前

(14). Refers to the preliminary assessment on safety, hygiene and environmental protection of used mechanical and electrical products conducted

是指对旧机电产品的安全、卫生、环境保护项目所进行的初步评价

(15). The inspection and quarantine administration or the institution engaging in pre-inspection before shipment recognized by SIQSAQ

由检验检疫机构或者经国家质检总局认可的装运前预检验机构

(16). Prior to the shipment of the said products at the port of departure in accordance with the compulsory requirements of the technical norms of the state

进口旧机电产品在启运港装运之前，依据我国国家技术规范的强制性要求

(17). To SIQSAQ or the entry-exit inspection and quarantine administration under the direct control of SIQSAQ in the locality where the consignee of used mechanical and electrical products is located as well as the processing of the relevant formalities

向国家质检总局或者进口旧机电产品的收货人所在地直属出入境检验检疫局申请货物登记备案，并办理有关手续的活动。

(18). The term “arrival inspection” refers to the qualification assessment conducted after the entry of used mechanical and electrical products, in accordance with the compulsory requirements of the technical norms of the state

“到货检验”是指进口旧机电产品入境后由检验检疫机构按照国家技术规范的强制性要求进行的合格评定活动。

(19). The whole-process administration conducted by the inspection and quarantine administration over consignee(s)and user(s)of used mechanical and electrical products imported concerning their sales and use of such products.

检验检疫机构对进口旧机电产品的收用货单位销售、使用旧机电产品活动全过程的管理。

(20). The state applies the record-keeping administration to import of used mechanical and electrical products. Those used mechanical and electrical products that fail to meet the designated requirements may not be put on record.

国家对允许进口的旧机电产品实施备案管理，对不符合规定要求的进口旧机电产品不予备案。

(21). The inspection and quarantine administrations conduct both pre-inspections and arrival inspections for the import of used mechanical and electrical products involving the items of safety, hygiene and environmental protection.

检验检疫机构对涉及安全、卫生、环境保护的进口旧机电产品实施装运前预检验和到货检验

(22). In case of any discrepancy, the arrival inspections shall prevail.

并以到货检验为准。

(23). For the import of other used mechanical and electrical products, only arrival inspections are required.

其他进口旧机电产品实施到货检验。

(24). SIQSAQ is in charge of the accreditation of institutions engaged in pre-inspections before shipment.

国家质检总局统一负责装运前预检验机构的认可工作。

(25). If necessary, SIQSAQ may accredit other inspection institutions to undertake the pre-inspections for a partial quantity of used mechanical and electrical products to be imported, and exercise supervision and administration over such institutions.

根据需要，可以认可其他检验机构承担部分进口旧机电产品的装运前预检验，并对其实施监督管理。

(26). The institutions should implement pre-inspections before shipment within the scope of authorizations and at the designation of SIQSAQ and the inspection and quarantine administrations under the direct control of SIQSAQ.

装运前预检验机构应当在授权范围内经国家质检总局和直属检验检疫局指派实施装运前预检验。

(27). No sales, installation and use of used mechanical and electrical products imported may be permitted that have not gone through arrival inspections

进口旧机电产品未经到货检验不得销售、安装和使用。

(28). Or fail to meet the compulsory requirements of the technical norms of the state concerning safety, hygiene, environmental protection, etc. during the arrival inspections.

或者经到货检验不符合我国有关安全、卫生、环境保护等国家技术规范的强制性要求的

(29). SIQSAQ is in charge of the training, qualification accreditation and administration of the persons engaging in the pre-inspections before shipment of used mechanical and electrical products to be imported.

国家质检总局统一负责对进口机电产品装运前预检验的人员的培训、资格认可和管理。

(30). No persons may engage in the pre-inspections of used mechanical and electrical products to be imported unless accredited by SIQSAQ.

未获得国家质检总局认可的人员不得从事进口旧机电产品装运前预检验工作。

(31). The consignees of used mechanical and electrical products imported or the agents thereof should apply for the processing of record-keeping formalities prior to the signing of contract in accordance with the provisions.

进口旧机电产品的收货人或者其代理人(以下简称备案申请人)应当按照规定在合同签署之前向备案机构申请办理备案手续。

(32). During the process of applying for record-keeping, the applicants should complete the Letter of Application for File-keeping of Import of Used Mechanical and Electrical Products

申请备案时，备案申请人应当填报《进口旧机电产品备案申请书》

(33). Which specifies the names, specifications, types, quantity, capital amount, production places, purposes and places of use of the used mechanical and electrical products to be imported

说明进口旧机电产品的名称、规格、型号、数量、金额、产地、制造日期、用途、使用地点等

(34). And provide other relevant documents as well in accordance with the relevant requirements. The application documents submitted by the record-keeping applicants shall be authentic and complete.

并按照有关要求提供其他相关资料。备案申请人提交的申请资料应当真实、完整。

(35). For the import of used mechanical and electrical products for the purposes of sales, leasing and repairs, etc. which are subject to the implementation of the compulsory product certification system and the import quality licensing administration

进口用于销售、租赁或者维修等用途且国家实施强制性产品认证制度、进口质量许可管理

(36). As well as the requirements of other provisions, the record-keeping applicants shall provide the corresponding certification documents during their applications.

以及有其他规定要求的旧机电产品的，备案申请人申请备案时必须提供相应的证明文件。

(37). The examination over the record-keeping applications by the record-keeping administrations include: examination over the authenticity, completeness and coherence of the record-keeping application documents

备案机构对备案申请的审核内容包括:对备案申请资料的真实性、完整性和一致性进行审核

(38). Checking whether the used mechanical and electrical products to be imported meet the requirements of the compulsory product certification system and the import quality licensing administration

进口旧机电产品是否符合强制性产品认证制度、进口质量许可管理的要求

(39). Checking whether the used mechanical and electrical products to be imported meet the compulsory requirements of the technical norms of the state concerning safety, hygiene, environmental protection, etc.

进口旧机电产品是否符合我国有关安全、卫生、环境保护等国家技术规范的强制性要求。

(40). After the record-keeping applications survive the examination, if the used mechanical and electrical products have to obtain the import certification documents issued by the Ministry of Commerce

(41). The relevant department(s)under the State Council or the local administrative organs in charge of import and export of mechanical and electrical products

(43). After the consignees or the agents thereof obtain the import certification documents, the record-keeping administrations may conduct the record-keeping.

收货人或者其代理人到相关部门取得进口证明文件后，备案机构予以备案

(44). If the obtaining of the said documents is not required, the record-keeping administrations may conduct the record-keeping directly.

(45). No record-keeping may be conducted for those applications that fail to meet the requirements upon examination.

(46). The record-keeping administration should, within 5 office days, determine whether a pre-inspection is needed for the batch concerned of the used mechanical and electrical products to be imported before their shipment.
