The administrative penalties prescribed in Article 44 shall be meted out by the department in charge of geology and mineral resources under the people’s government of a province, autonomous region or municipality directly under the Central Government. 第四十四条 规定的行政处罚，由省、自治区、直辖市人民政府地质矿产主管部门决定。给予吊销勘查许可证或者采矿许可证处罚的，须由原发证机关决定。
